Terms of service
Last updated
These terms cover Leva, our takeoff service at app.runleva.com, including Leva in ChatGPT and other assistants, and this website, runleva.com (together, the “service”). Leva is a product of Leva Solutions Pty Ltd (ABN 80 692 829 299), based in Sydney NSW 2000, Australia (“we”, “us”).
By signing up for Leva, connecting it to an assistant or using the website, you agree to these terms. If you use Leva for a business, you agree for that business, and “you” includes it. If you don’t agree, please don’t use the service.
Signed agreements
If your business has signed a written agreement with us for Leva, that agreement prevails where it conflicts with these terms.
Your account
- Leva is for business use. You must be at least 18 and able to agree to these terms for yourself or your business.
- Give accurate details when you sign up, and use your work email.
- Keep your sign-in details safe. Tell us straight away at hello@runleva.com if you think someone has used your account without permission.
- You are responsible for what happens in your account, including what the people you invite do in it.
Sign-up and free takeoffs
A business that signs up gets three free takeoffs, with no card needed. A takeoff counts when it starts, unless it fails on our side or is stopped before it begins. Changes you ask for on a job that already has a takeoff, and answers to Leva’s questions, don’t use up a takeoff.
The free takeoffs are one set per business, so please don’t create extra accounts to get more. We may change the free offer for new sign-ups.
When your free takeoffs are used, you can book a call with us to keep going. We will agree any fees with you in writing before we charge you.
Leva in ChatGPT and other assistants
You can connect Leva to ChatGPT, Claude or another assistant by signing in to Leva and choosing Allow. The assistant can then create jobs, add drawings, run takeoffs, answer Leva’s questions and read results in the Leva account you chose, within your permissions there. Takeoffs started from an assistant count toward your takeoffs in the same way.
You can disconnect at any time at app.runleva.com/assistants or in the assistant. The assistant is provided by another company under its own terms and privacy policy. We aren’t responsible for the assistant or for what it does with the content of your conversation.
Your content
You keep ownership of the drawings, documents, catalogs, prices and other content you put into Leva, and of the takeoffs, reports and quotes Leva produces for you (“your content”).
You give us a non-exclusive, worldwide license, free of charge, to host, copy, process, send and display your content, including through our service providers such as OpenAI, only as needed to provide, support and secure the service for you, or as the law requires. The license ends when your content is deleted, except for copies in backups until they age out.
You confirm that you have the right to put your content into Leva and to let us process it this way, including any personal information in it. Our privacy policy explains how we handle personal information.
We keep your catalogs and prices confidential. We never share them with another supplier, pool them across suppliers or use them to set anyone else’s prices. We don’t use your content to train models that serve other customers unless you agree.
Takeoffs are estimates
Leva uses AI to read drawings and measure quantities. Its takeoffs are estimates for a person to review, not final figures. AI can misread a drawing or miss an item, and drawings can be unclear, incomplete or out of date.
Before you rely on a takeoff, or use it in a quote or estimate, a competent person on your team must check it against the drawings. Leva marks each quantity on the drawing and raises questions to help with that. You are responsible for the quotes, estimates and other decisions you make using Leva.
Leva doesn’t give engineering, design or other professional advice. The videos, examples and quantities on this website show how Leva works. They are not an estimate, a quote, professional advice or an offer to supply goods.
Acceptable use
You must not:
- use the service in a way that breaks the law or anyone’s rights;
- upload malware, or content you don’t have the right to use;
- try to gain unauthorized access, probe or test the service’s security, or interfere with how it works;
- get around limits such as the number of free takeoffs, or send automated requests beyond normal use (search engine indexing of the website, and assistants you connect, are fine);
- copy, scrape or frame substantial parts of the website, use its content to train machine learning models, or use the service to build a competing product; or
- misrepresent who you are or any connection with us.
The service as provided
We work to keep Leva available, secure and accurate, and we keep improving it, so features can change. Leva runs on third-party infrastructure and AI models, and can have outages or errors.
Apart from the guarantees described under Australian Consumer Law, we provide the service “as is” and “as available”. To the extent the law allows, we make no other promises about it, express or implied, including that it will be uninterrupted or error-free, or that takeoffs will be complete or accurate.
Our intellectual property
The website and the Leva software, with their text, videos, images and designs, and the Leva name and logos, belong to us or our licensors. While you follow these terms, you may use the service for your business. No other rights are granted. If you send us feedback or ideas, we may use them without any obligation to you.
Other websites and services
Other websites and services that the website links to, and the assistants you connect, are run by others. We don’t control them and aren’t responsible for their content or practices.
Privacy
Our privacy policy explains how we handle personal information, and our cookie policy describes the cookies and similar technologies we use.
Australian Consumer Law
Our services come with guarantees that can’t be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or changes any right, remedy or guarantee you have under the Australian Consumer Law, or under any other law, that can’t lawfully be excluded.
Limits on our liability
To the extent the law allows:
- we are not liable for indirect or consequential loss, or for loss of profit, revenue, data or goodwill, arising from the service;
- we are not liable for loss that comes from relying on a takeoff that no person checked, or from errors in the drawings or other content you provide; and
- our total liability for all claims relating to the service is limited to the fees you paid us for it in the 12 months before the claim, or A$100 if that is more.
Where the Australian Consumer Law applies and our liability for failing to comply with a consumer guarantee can be limited, it is limited to supplying the services again or covering the cost of having them supplied again.
Your responsibility
If you break these terms or misuse the service, you are responsible for the loss this causes us, including reasonable legal costs, to the extent the law allows.
Suspending or closing an account
You can stop using Leva at any time. If you own your business’s account, email hello@runleva.com and we will close it. We delete a closed account’s data within 90 days; copies in backups age out on their normal cycle after that.
We may suspend or close an account, or disconnect an assistant, if you break these terms, if your use puts the service, other customers or us at risk, or if the law requires it. Where it’s reasonable, we will tell you first and give you a chance to fix the problem. If we stop offering Leva, we will give account owners reasonable notice.
The sections on your content, takeoffs being estimates, liability and governing law keep applying after an account closes.
Changes to these terms
We may update these terms, for example when Leva or the law changes. We will post the new version here with its date. If a change significantly affects you, we will tell account owners by email or in Leva before it takes effect. If you don’t agree with a change, you can stop using Leva and close your account. Using the service after a change takes effect means you accept it.
Governing law
These terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts that can hear appeals from them.
If the law where you live or do business gives you rights that can’t be excluded or waived by agreement, nothing in these terms takes those rights away.
General
If part of these terms is invalid, the rest still applies. If we don’t enforce a right straight away, we can still enforce it later. You may not transfer your rights under these terms; we may transfer ours to a successor to our business.
